  • Crying Nut wins first round of courtroom battle against CN Blue

  •  Seoul Central District Court  rejected CN Blue which filed a lawsuit against Crying Nut, saying the team spread malicious rumors about CN Blue.

     
    The two went to court over the use of music source without prior consent.
    As for CN Blue's countersuit, the court ruled in favor for Crying Nut.
     
    On September 25th it was announced that Judge Kang Hyung-joo rejected CN Blue and their agency FNC Entertainment's request forcing Crying Nut members to stop spreading rumors.
     
    The trouble began in June of 2010, CN Blue performed in a cable tv show with Crying Nut's music for "Pilsal Offside" playing on the background.
    The DVD with this clip with the Crying Nut song in it has been sold in Japan. 
    CN Blue claimed that the station ordered the band to play the original music by Crying Nut and they had to comply.
    But Crying Nut filed a lawsuit against CN Blue in February this year for copyright infringement.
    CN Blue filed a countersuit for defamation, claiming Crying Nut spread false rumors about CN Blue.
     
    The court concluded that the basis for CN Blue's countersuit is personal opinion and that it is difficult to conclude that Crying Nut wrote about the incident with the intent to defame CN Blue.
     
    Crying Nut's lawsuit is currently being reviewed by the same court of law.
